ь At present all 22 commercial banks of the Kyrgyz Republic are functioning; herewith provisional management was introduced in six commercial banks of the Kyrgyz Republic, including AUB, Manas Bank, KyrgyzCredit, Issyk-Kul, Akylinvestbank and Bakai.
As a result of the event of April 7-8, 2010, stabilization of individual banks operation was prevented by the following:
· Decrease in the network of automated teller machines and terminals for service of banking cards as well as payment terminals, assigned for acceptance of regular payments from the population.
· Difficulties in performance of trans-frontier (international) payments with correspondent banks as well as performance of money transfers, settlement of payments and mutual settlements between legal entities.
· Loss of monetary assets in individual banks due to stealing of money from broken automated teller machines and payment terminals.
On April 8, 10 and 12, 2010, National Bank of the Kyrgyz Republic introduced provisional management in 7 commercial banks (Provisional administration was cancelled in the OJSC Dos-Credobank in accordance with the resolution of the NBKR Board, dated April 20, 2010) on the basis of resolutions of the prosecutor's office.
From the moment of provisional management introduction, authorities of Boards of Directors and Management Boards of the above-mentioned banks were terminated. Provisional Director is assigned with authorities of the Board of Directors and Management Board for the purpose of control over the capital movement and provision of bank’s assets maintenance to the benefit of depositors and other creditors of the bank. In accordance with the bank’s information, first of all the measures on maintenance of assets were accepted; for this purpose banking transactions were limited, including all transactions with insiders and affiliated entities as well as associated persons.
In the banks, where provisional management was introduced, the limitations were gradually cancelled with regard to the current situation analysis and needs of the bank’s clients (physical and legal entities, individual businessmen – residents and non-residents of the Kyrgyz Republic). Nowadays, service of clients in the above-mentioned commercial banks is restored in full, except for the services, related to issuance of credits and equal assets, investments to capital, securities (except for governmental) as well as investments into fixed assets and non-material assets, transactions with insiders and affiliated entities.
As for the OJSC AsiaUniversalBank, some transactions with non-resident legal entities of the Kyrgyz Republic as well as transactions with resident legal entities were still terminated and limited with the amount of one million soms. Also the CJSC Manas Bank does not perform transactions with non-resident legal and physical entities of the Kyrgyz Republic.
Employees of the National Bank of the Kyrgyz Republic, who are included in the provisional management of banks, perform calculation of assets and evaluation of current state of the banks, where the activity on maintenance of assets is arranged. In all banks, where the special supervision regime was introduced, assets of banks cover the liabilities; there are liquid funds to repay assets of physical entities – clients of banks at a time.
Payment system of the Kyrgyz Republic is functioning uninterruptedly, in the regular mode. The National Bank of the Kyrgyz Republic continues to perform supervision over activity of all commercial banks in the republic. Banks, where the special administration regime was introduced, perform payments and settlements under control of the Provisional Management. Provisional Management of the above-mentioned banks provides daily reports to the National Bank of the Kyrgyz Republic.
The National Bank of the Kyrgyz Republic publishes in the on-line mode the NBKR resolutions, accepted with regard to the banks. In general, the banking system of the republic is stable. Liquidity is sufficient. The National Bank of the Kyrgyz Republic accepts and will accept all required measures for protection of depositors and clients of banks.
ь On April 26, 2010, the NBKR Board made the decision on liberalization of transactions of legal entities, clients of the OJSC AsiaUniversalBank – residents of the Kyrgyz Republic, except for insiders and affiliated companies as well as individuals, associated with them by common interests and other entities, specified in resolutions of agencies of the prosecutor's office.
ь The National Bank of the Kyrgyz Republic informs that on April 23, 2010, monetary assets of the Russian Federation Government grant in the amount of 20 million US dollars were transferred to the specially opened account of the Ministry of Finance of the Kyrgyz Republic.
ь The National Bank of the Kyrgyz Republic informs commercial banks that the project of changes and amendments to the resolution of the NBKR Board No.18/3 “On approval of new edition of the Provision of classification of assets and relevant deductions to the reserve for coverage of potential losses”, dated July 21, 2004, registered in Ministry of Justice of the Kyrgyz Republic on August 23, 2004 (registration number 95-04), is provided on the official web-site of the National Bank of the Kyrgyz Republic in the section Normative acts/Projects for discussion. The Department of Supervision and Licensing Methodology asks to provide comments and proposals on this project to the following address at the earliest possible date cshapieva@nbkr.kg.
