1. General Provisions 

1.1. This Regulation determines a single form of periodic regulatory bank reporting (hereinafter referred to as “PRBR”).

1.2. The Regulation on PRBR is applied to all commercial banks, including those having an “Islamic window”, OJSC “Financial Company of Credit Unions” licensed by the National Bank of the Kyrgyz Republic (hereinafter referred to as the National Bank), and the State Development Bank of the Kyrgyz Republic (hereinafter referred to as the banks).

1.3. The PRBR is drawn up on the basis of accounting and ad hoc records data. 

2. Goals and Objectives 

2.1. The PRBR is drawn up in order to conduct analysis: 

а) of the financial condition of the bank within the framework of the functions performed by the National Bank of the Kyrgyz Republic, which are provided for in the Law of the Kyrgyz Republic “On the National Bank of the Kyrgyz Republic, Banks and Banking Activity”; 

b) of the activities conducted by the bank to contribute to managerial decision-making by the heads, including the decisions on ensuring liquidity, solvency and profitability.

2.2. The main objective of the PRBR is to provide reliable and complete information on the economic and business activity of the bank in order to ensure the fulfillment of the goals specified in clause 2.1 of this Regulation. 

3. Contents and Frequency of PRBR Presentation  

3.1. The PRBR is a reporting of the banks activities, drawn up in the prescribed form for a specified period and submitted in a timely manner. 

3.2. The contents of the consolidated reporting, a summary and terms of reports presentation are given in Appendix No. 1 to this Regulation. 

3.3. The PRBR consists of 37 sections.

4. Procedure of PRBR Presentation  

4.1. An employee, who is responsible for the contents completeness, the date of presentation and the correctness of filled out PRBR, shall be appointed in each bank. This employee shall also be responsible for interaction with the National Bank on all issues relating to the information contained in the PRBR. 

4.2. The PRBR is presented to the National Bank in the form in accordance with Appendix No. 2 to this Regulation within the time limits established for each report, in hard copies and through the electronic communication system (electronic data storage devices). 

4.3. The reports shall be presented in hard copies to the National Bank within a fixed timeframe. The reports shall be presented in separate sealed envelopes containing sections 1-18, 23, 25 and 32, respectively. The envelopes shall contain the numbers of the PRBR sections.

4.4. The soft copies of the PRBR sections 1-37 shall be submitted to the National Bank. Meanwhile, the soft copies of the PRBR sections 19-37 shall be provided with an electronic digital signature (EDS). The cover letters of the set format to the relevant sections of the PRBR shall also be signed by the EDS and presented in electronic format.

4.5. In case of any inconsistencies, errors, incomplete provision or incorrect filling out the PRBR forms, the relevant structural subdivision of the National Bank notifies the bank about the need to adjust the report with a reflection in the financial statements within the following timeframes: 

- for a daily and weekly report - within 2 working days, monthly and quarterly reports within 3 working days; 

- for a monthly report - within 10 working days; 

- for a quarterly report - within 10 working days; 

- for a semi-annual report - within 15 working days; 

- for an annual report - within 30 working days. 

Adjusted reports together with the banks cover letter shall be presented to the National Bank: daily and weekly reports within 2 working days, and all other reports within 5 working days.

4.6. If the National Bank gives no comments on the PRBR, or when the report has been brought in compliance with the comments of the National Bank and confirmed by a bank letter, the PRBR shall be considered accepted by the National Bank. 

4.7. The branches of the commercial banks located in the remote regions shall submit on monthly basis information to the relevant regional branch of the National Bank about their activities by the 15th day of the month following the reporting month after submission of the consolidated PRBR by the primary bank. The list of the PRBR sections to be provided by the banks branches to the regional branch of the National Bank with the approval of the supervising Deputy Chairman/a member of the Board of the National Bank shall be established by the relevant structural subdivision of the National Bank.

4.8. The annual PRBR shall be submitted to the National Bank at least on February 15 of the year following the reporting year. 

4.9. A copy of the published financial statements with the conclusion of an independent auditing company after approval by the shareholders meeting within two working days shall be submitted to the General Affairs Division of the National Bank.

4.10. The information for the weekends and public holidays announced and recommended by the Government of the Kyrgyz Republic as the working days for the National Bank and the commercial banks, regardless of whether a bank worked during this period or not, shall be included in the PRBR and submitted within the set timeframes. At the same time, the reports containing information on foreign currency in KGS equivalent shall be drawn up using the National Banks policy rate as of the date of the report. 

4.11. The periodic regulatory bank report shall be duly presented: tied together, numbered with specified quantity of pages of the PRBR sections, sealed and signed by the banks employee responsible for drawing up and submitting the PRBR. 

4.12. The PRBR shall contain reliable information about the condition of the bank as of the reporting date. The correctness of the information on the banks condition reflected in the monthly, quarterly and annual PRBR shall be certified by the Chairman of the banks Board of Directors or by a member of the Board of Directors who fulfills the duties of the Chairman in his absence, the Chairman of the banks Board, the Chief Accountant and a member of the banks Board supervising the work on drawing up the report.

5. Final Provisions 

5.1. A bank shall be liable according to the legislation of the Kyrgyz Republic for failure to provide information, for untimely and/or incorrect presentation of information, as well as for incorrect filling out the PRBR.
